Supreme Court Rules: Pre-Trial Detention Cannot Become Punishment Without Trial
A Supreme Court bench comprising Justice Dipankar Datta and Justice Sheel Nagu has granted regular bail to Mahesh Chandra Joshi (former Congress Minister) and Mukesh Pathak in connection with the Rs. 979 Crore Rajasthan Jal Jeevan Mission corruption case.
The Core Constitutional Principle: Reaffirming the sanctity of Article 21 of the Constitution, the Apex Court firmly observed that an undertrial’s right to personal liberty and a speedy trial must remain protected. The Bench clarified that while allegations of massive financial impropriety and institutional collusion in public welfare projects demand rigorous scrutiny, the sheer gravity of these allegations cannot be used to justify indefinite pre-trial detention.
Key Factors Leading to Bail:
Evidence is Secure: With chargesheets already filed, the prosecution relies heavily on documentary and electronic evidence—including official correspondence, bank statements, and forensic reports—which are safely in the custody of the investigative agency, removing any risk of tampering.
Custody Duration: The Court considered the significant time already served; Joshi, a 72-year-old senior citizen, had been incarcerated for over five months, while Pathak had been in continuous custody for nearly eight months.
Voluminous Case Records: The sheer scale of the impending trial—featuring 22 accused, 124 prosecution witnesses, and 192 documents spanning 20,000 pages—indicated that the legal proceedings would take a considerable amount of time to conclude.
Parity and Prior Bail: Both accused had already secured bail in parallel PMLA and CBI proceedings based on the same factual matrix, and multiple co-accused in the current case had also been granted relief.\
Concluding that further imprisonment was unnecessary, the Court directed the release of the appellants under stringent conditions to ensure full cooperation with the law.
